
Opposition Leaders Challenge Waqf Amendment Bill in Supreme Court
As of April 5, 2025, Asaduddin Owaisi (AIMIM MP), Amanatullah Khan (AAP MLA), and the Congress Party, through MP Mohammad Jawed, have separately challenged the Waqf Amendment Bill 2025 in the Supreme Court of India. The bill, passed by the Lok Sabha on April 3 and the Rajya Sabha on April 4, awaits Presidential assent. These opposition leaders argue that the legislation violates constitutional rights and discriminates against Muslims.
Owaisi’s Petition: Bill Violates Fundamental Rights
Owaisi filed his petition on April 4, contending that the bill infringes on fundamental rights under Articles 14, 15, 25, and 26, which ensure equality, non-discrimination, and religious freedom. He claims it undermines Muslim autonomy over Waqf properties by allowing non-Muslim members on Waqf councils and boards, a provision he deems unconstitutional.

Khan’s Plea: Legislation Curtails Muslim Autonomy
Khan, filing on April 5, echoes these concerns, arguing the bill violates Articles 14, 15, 21, 25, 26, 29, 30, and 300-A. He asserts it curtails Muslim religious and cultural autonomy, enables arbitrary executive interference, and weakens minority rights to manage their institutions.
Congress Party’s Stand: Bill Discriminates Against Muslims
The Congress Party’s challenge, led by Mohammad Jawed on April 4, highlights the bill’s alleged discrimination against Muslims. Jawed, a member of the Joint Parliamentary Committee on the bill, argues it imposes restrictions—like limiting Waqf creation based on years of religious practice—not applied to other religious endowments, violating equality and religious freedom.
Government’s Defense and Ongoing Debate
The government defends the bill, stating it aims to enhance transparency and efficiency in Waqf property management, benefiting Muslim women and ensuring accountability. Critics, however, see it as an overreach into religious affairs. The Supreme Court has yet to hear these petitions, and the outcome remains pending.
